2. Summary

3. Hosting and server log files

This website is hosted by: STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany. We have concluded a data processing agreement with the provider pursuant to Art. 28 GDPR. The servers are located in Germany or the European Union.

When you visit the website, your browser automatically transmits information that is stored in server log files: IP address, date and time of access, requested page or file and amount of data transferred, HTTP status code, referrer URL, browser and operating system.

We need this data to deliver the website, to ensure its stability and security and to detect misuse. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is the secure and error-free operation of the website. The data is not combined with other data sources. Log files are deleted automatically after a short period unless they are needed for longer to investigate a specific security incident.

4. SSL/TLS encryption

This website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser’s address bar. Data you send us through the contact form cannot be read by third parties.

5. No cookies, no local storage

We do not store information on your device and do not access information stored there unless this is strictly necessary to display the website (§ 25 TDDDG). This is why this website does not need a cookie banner.

6. Contact form

If you write to us using the contact form, we process the information you enter: name, email address, topic and message (required) and – if provided – company, phone number and requested quantity. We also store the time of your request.

The information is sent by email to our mailbox kontakt@ma-handels.de and used only to handle your request and any follow-up questions. The legal basis is Art. 6(1)(b) GDPR where your request relates to entering into or performing a contract, and otherwise Art. 6(1)(f) GDPR (our legitimate interest in answering enquiries).

To protect against automated spam, we use an invisible form field and a time check. No additional personal data is collected and no third-party services are involved.

We delete your request once it has been fully handled, unless statutory retention obligations apply. If a request leads to a business transaction, the retention periods under German commercial and tax law (§ 257 HGB, § 147 AO) of up to ten years apply.

Providing your data is voluntary. Without the required details, however, we cannot handle your request.

7. Contact by email or phone

If you contact us by email or phone, we process your details (for example name, contact details and the content of your request) to handle your enquiry. Legal bases and storage periods are the same as for the contact form.

8. WhatsApp

Our website contains a link that lets you message us on WhatsApp. It is a plain link: no data is transmitted to WhatsApp when you visit our website. WhatsApp or the WhatsApp website only opens once you click the link.

The provider of WhatsApp in the European Economic Area is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. Data may be transferred to the parent company Meta Platforms, Inc. in the USA. Meta is certified under the EU-US Data Privacy Framework, for which the European Commission has adopted an adequacy decision. For details of the data WhatsApp processes, see its privacy policy: www.whatsapp.com/legal/privacy-policy-eea.

If you contact us via WhatsApp, we process your phone number, profile name and the content of your messages to answer your request. The legal basis is Art. 6(1)(b) or (f) GDPR. Using WhatsApp is voluntary; you can always reach us by email or through the contact form instead. We recommend these channels for confidential information.

9. Recipients

Your data is only accessible to the people in our company who need it to handle your request, and to our hosting and email provider as processors. We only pass data on to other third parties if this is necessary to perform a contract (for example to freight forwarders for a delivery) or if we are legally obliged to do so.

10. Your rights

You have the right to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18) and data portability (Art. 20).

Right to object (Art. 21 GDPR): where we process data on the basis of Art. 6(1)(f) GDPR, you may object to this processing at any time on grounds relating to your particular situation.

A simple message to kontakt@ma-handels.de is enough to exercise your rights.

You also have the right to lodge a complaint with a data protection supervisory authority. The authority responsible for us is: Landesbeauftragte für Datenschutz und Informationsfreiheit Nordrhein-Westfalen, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany, www.ldi.nrw.de.

11. Automated decision-making

We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR.

12. Changes to this privacy policy

We update this privacy policy when the website or the legal requirements change. The version published here applies.
